Terms of Service

Last updated: 2026-10-22 (version 2026-10-22)

DRAFT — pending legal review. This text has not yet been reviewed by a lawyer and is not legal advice.

1. Acceptance of Terms

By accessing or using Avokati AI ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to all of these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and the operator of the Service identified in the business details below ("the Provider", "we", "us" or "our").

2. Description of Service

Avokati AI is a legal research tool. It indexes public legal sources — EU law, Albanian law, Kosovo legislation, and the case law of the European Court of Human Rights, the Court of Justice of the European Union and the International Court of Justice — and uses artificial intelligence to help you search, read and compare them. Features include an AI-assisted chat, a document explorer, saved searches, alerts, personal knowledge bases, an API and an MCP endpoint. The Service assists research; it does not perform it for you.

3. Not legal advice

Nothing provided by the Service constitutes legal advice, and using the Service does not create a lawyer–client relationship between you and the Provider, its staff or any contributor. Answers are generated automatically from the indexed texts and are not reviewed by a lawyer. If you need advice on a specific matter, consult a licensed lawyer in the relevant jurisdiction. If you are a lawyer, you remain solely responsible for the advice you give your own clients.

4. Accuracy and verification

Outputs may be incomplete, outdated or wrong. In particular:

  • Consolidated texts may lag behind amendments; an act shown as in force may have been amended, repealed or suspended after our last update.
  • The AI may misread, mistranslate or over-generalise a provision, or cite a passage that does not support the point.
  • Coverage of any source is partial; the absence of a result does not mean no such law or decision exists.

You must verify every result against the official sources before relying on it: the QBZ (Qendra e Botimeve Zyrtare) for Albanian law, EUR-Lex for EU law, HUDOC for ECHR case law, and the Official Gazette of Kosovo for Kosovo legislation. Where the Service links to an official source, the official source prevails.

4.1 Warranty

[lawyer to draft] — disclaimer of express and implied warranties (accuracy, completeness, fitness for purpose, non-infringement) to the extent permitted by Albanian law and, for EU consumers, the mandatory consumer protection rules of their country.

4.2 Limitation of liability

[lawyer to draft] — exclusion of indirect and consequential loss, liability cap, and the carve-outs that cannot be excluded (intent, gross negligence, personal injury, mandatory consumer rights).

5. Eligibility — 18+ only

The Service is a professional tool for adults. You must be at least 18 years old and able to enter into a binding contract to use it. We do not offer the Service to children and do not knowingly collect their data. For users in the European Union, we note that GDPR art. 8 sets the age of digital consent at 16 (or lower where a Member State provides); because the Service is limited to adults, no parental consent flow is offered. If we learn that a minor has registered, we will close the account and delete its data.

6. User accounts

6.1 Registration

You must provide accurate information and use a valid, non-disposable email address that you personally control. We may reject or terminate accounts registered with disposable, temporary or alias email services. Each person may hold one account.

6.2 Account security

You are responsible for all activity under your account and for keeping your login links, API keys and devices secure. Notify us immediately through the contact address in the business details if you suspect unauthorised use.

6.3 Consent to these Terms

Each version of these Terms carries a date and version number. When you sign up, and again whenever the version changes, you are asked to accept the current version; we record which version you accepted and when.

7. Acceptable use

You agree to use the Service only for lawful purposes. The following are prohibited:

7.1 Illegal and harmful activity

  • Any use that violates applicable local, national or international law.
  • Seeking help with fraud, identity theft, money laundering, tax evasion or other crimes.
  • Generating content that promotes violence, terrorism, self-harm or the exploitation of minors.
  • Using the Service to stalk, harass, threaten or intimidate anyone, or to infringe third-party intellectual property or privacy rights.
  • Uploading personal data of third parties without a lawful basis to process it.

7.2 AI-specific misuse

  • Attempting to bypass, disable or "jailbreak" safety filters, or using prompt injection or adversarial inputs to make the system produce prohibited content.
  • Presenting AI-generated output as human-authored professional legal advice.
  • Systematically extracting answers to train competing models, or reverse engineering the Service.

7.3 Platform abuse

  • Scraping, crawling or bulk-extracting data other than through the official API within its limits.
  • Interfering with or placing an unreasonable load on the Service or its infrastructure.
  • Attempting to access other users' accounts or any system without authorisation.
  • Creating multiple accounts to evade bans, quotas or rate limits.
  • Reselling or redistributing access without our written authorisation.

8. API keys, rate limits and fair use

Access through the API or the MCP endpoint requires an API key issued to your account. Keys are personal: do not share them, embed them in public code or use them on behalf of third parties. Building a product, service or integration that gives third parties access to the Service or its answers, whether free or paid, requires a written API agreement with us; without one, a key may only serve your own account's use. All accounts are subject to request rate limits and daily and monthly token quotas that vary by plan; we may throttle, queue or temporarily restrict access to protect platform stability. Usage is logged per key for security and billing as described in the Privacy Policy. We may revoke keys used in breach of these Terms. Limits, features and pricing may change with reasonable notice.

9. Content and output

9.1 Your content

You retain ownership of the questions and documents you submit ("Input"). You grant us the licence needed to process Input in order to provide the Service, including sending it to the processors listed in the Privacy Policy. You are responsible for having the right to upload what you upload.

9.2 Generated output

Output is provided for research purposes only, may not be unique, and is subject to section 4. You may use Output for your own work provided you verify it and do not present it as advice from the Provider.

9.3 Public legal texts

Legal documents from official registries (EUR-Lex, QBZ, the Official Gazette of Kosovo, HUDOC, CURIA, the ICJ) are public documents; the Service's interface, software, prompts, indexes and branding are owned by the Provider and licensed to you only for use of the Service under these Terms.

10. Availability

We aim to keep the Service available but do not promise uninterrupted or error-free access. The Service may be unavailable during maintenance, updates, upstream provider outages or events outside our control. Index updates from official sources run on a schedule and may be delayed. Any warranty as to availability is governed by section 4.1.

11. Termination and account deletion

11.1 By you

You may delete your account at any time from account settings (or with DELETE /api/v1/users/me), or by writing to the contact address in the business details. Deletion erases your data as described in the Privacy Policy within the 30-day statutory window; a minimal erasure record is kept as proof.

11.2 By us

We may suspend or terminate your account for breach of these Terms, for use that threatens the security or integrity of the Service, or where required by law. Where reasonable we will notify you and give you the opportunity to export your data. We may retain records of violations for legal and compliance purposes.

11.3 Survival

Sections 3, 4, 9, 12 and 13 survive termination.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Albania [lawyer to confirm]. Disputes are subject to the jurisdiction of the courts of Tirana, Albania [lawyer to confirm venue and consumer carve-outs]. If you are a consumer in the European Union, mandatory provisions of the law of your country of residence, and your right to bring proceedings there, are not affected. Before starting proceedings, you agree to contact us and attempt to resolve the dispute informally for thirty (30) days.

13. General provisions

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and the Provider regarding the Service. Severability. If a provision is held invalid, the rest remains in force. No waiver. Not enforcing a provision is not a waiver of it. Assignment. You may not assign these Terms without our written consent; we may assign them to a successor operator with notice.

14. Changes to these Terms — versioning

Each revision of these Terms is identified by the "Last updated" date and version shown under the title. We will post material changes on this page and ask you to accept the new version at your next sign-in; for significant changes we may also notify you by email. Continued use after accepting a new version constitutes agreement to it.
